GayPornAccess Terms and Conditions

The following terms and conditions reflect the obligations of the WEBMASTER and of Perfect Web Ideas (herein called PWI) in all instances when a WEBMASTER participates in PWI’s promotional programs to promote the gaypornaccess.com network. All conditions must be adhered to, and are legally binding.

The following describes the rights and obligations to be observed by PWI and by the WEBMASTER, in promotion of the gaypornaccess network.

• PWI will not tolerate any illegal or offensive methods of promotion of its websites. PWI maintains the right to decide whether or not a promotion method is offensive.
• Webmasters agree not to engage in the following activities in connection with marketing or promotion of the gaypornaccess.com network: sending SPAM, instant messaging (i.e. IMs, ICQs, irc, AOL etc..); the direct or indirect promotion of child pornography (including visual depictions of sexual behavior involving children regardless of the age of the models), violence or other patently offensive or prohibited speech via images, tags, links or content of any kind; violations of copyright, trade or service mark or otherwise protected or patented materials, services, intellectual property or processes; artificial or false generation of hits, click-through or traffic to gaypornaccess.com; misleading or defrauding the sponsor or any other affiliate; misrepresenting the cost, content or any other aspect of the service provided by gaypornaccess.com Infringing Webmasters will be terminated from the program, all illegal activities will be reported to the relevant agencies and all monies due will be held.

• PWI will not be held responsible for loss due to downtimes resulting from interruption of service, hardware or technical errors.

• The WEBMASTER’s use of gaypornaccess.com and its zones constitutes the WEBMASTER’s agreement to all terms, conditions, and notices as defined by PWI. Failure to comply with any of the terms and conditions will lead to termination of the WEBMASTER’s account. All monies due will be held and all future payment void. No warnings will be issued. A WEBMASTER’s membership in the gaypornaccess.com Revenue Program may be terminated at the sole discretion of PWI. In such cases, all accounts owned by the WEBMASTER in the gaypornaccess program will be terminated and the WEBMASTER will be blocked from the program indefinitely.

• The WEBMASTER will provide PWI with a valid business/personnal information and a valid email address to be used for contact purposes.

• PWI must be able at all time to track hits and visits from websites used by the WEBMASTER to promote gaypornaccess.com.

• Credit card fraud is closely monitored and will not be tolerated by PWI. Every case of credit card fraud is reported to the companies concerned (Visa, Mastercard...) and the relevant authorities and government agencies. Legal action will be brought against any WEBMASTER that will be deemed responsible for any sort of mechanism that falsely generates signups to the website.

CONDITIONS SPECIFIC TO PROMOTIONAL METHODS

The following conditions define the promotional methods allowed by PWI in promoting the gaypornaccess.com network.

• Surfers that are referred by the WEBMASTER to the PornAcess.com network or one of its websites must join the website(s) of their free will, and not on condition of receiving services or goods in return.

• Misleading advertising by the WEBMASTER is prohibited. The misrepresentation of price is also prohibited. A WEBMASTER may not use the term “free” in connection with promotion of the gaypornaccess.com network.

• The WEBMASTER must provide access to any page gaypornaccess.com is promoted, whether or not these pages are protected by a password (such as a member’s section). Failure to comply will result in termination of the account. All monies due will be held, all future payments will be stopped.

• The WEBMASTER will be paid 50% the WEBMASTER generated from zone on the gaypornaccess.com network when the sale was generated by the WEBMASTER on site created by another webmaster (called traffic sales) . The WEBMASTER will continue to receive 50% of the above mentioned profits for as long as the surfers renew their memberships, without limitation.

• The WEBMASTER will be paid, according to the selected payment method, 50% of the Net Revenue or $30 per sign up from sites on PornAccecss.com when the sale was generated by the WEBMASTER on sites created by another webmaster (called: Traffic Sale). If the selected payment method is: affiliate (rev-share) the WEBMASTER will continue to receive 50% of the above mentioned profits for as long as the surfers renew their memberships, without limitation.

• The WEBMASTER will be paid, according to the selected payment method, 65% of the Net Revenue or $35 per sign up when the sale was generated by the WEBMASTER on sites created by him. If the selected payment method is: affiliate (rev-share), the WEBMASTER will continue to receive 65% of the above mentioned profits for as long as the surfers renew their memberships, without limitation.

• The WEBMASTER will be paid, according to the selected payment method, 15% of the Net Revenue or $5 per sign up when the sale was generated by another member of the program on sites that the WEBMASTER created (called: Site Sale). Sign ups by a WEBMASTER's family member, co-worker, friend or any other person directly related to the WEBMASTER constitute FRAUD and will lead to the termination of the account and withholding of all monies due.

• Net Revenue is defined as: Total Revenue less credits, chargeback and other deductions. In case of loss of funds due to deductions or chargebacks the credited amount will be applied as a deduction to the WEBMASTER’s account.

• Memberships generated by customers who refuse cookies will not be tracked by PWI.

• Members of the WEBMASTER’s family, friends and relatives as well as the WEBMASTER himself or anyone working with or for the WEBMASTER are not authorized to join the gaypornaccess.com network using the WEBMASTER’s account. If the WEBMASTER wishes to test PWI’s system, he must e-mail PWI to indicate the transaction before or following the test, without fail.

• The commissions paid for a specific signup by PWI will be deducted from the WEBMASTER’s account if that signup is identified as a fraudulent transaction.
Referring other Webmasters to the gaypornaccess program:

• The WEBMASTER is prohibited from referring an employee within his own organization or direct family member (PWI will monitor this carefully).

• The WEBMASTER cannot refer someone that already has an account in one of our cash programs.

• Inactive referred accounts might be disabled by PWI without prior notice.

• The referring WEBMASTER will earn a 5% recurring commission on the total commission made by his referred webmaster accounts on traffic sales.

PAYMENT

• The earnings due to the WEBMASTER are calculated by PWI. The WEBMASTER can see the amount owed to him in the statistics section of PWI’s program.

• All payments will be made in US Dollars. Payments will be made on a bi-weekly schedule: from the 1st to the 15th of each month and from the 16th to the end of each month. Payments are sent by PWI within 5 business days of the end of a payment period. With the exception of payments sent by wire transfers, payments are sent if minimum payout of $50 is reached. If not reached, the monies are carried over until minimum payout is reached. The minimum payout for wire transfer is $250.

• Using incorrect payout names or providing the program with false information is considered fraud (especially if the WEBMASTER is caught infringing the rules on another account). The account will be terminated and all payments stopped.

• If a payment is not received by the WEBMASTER, there is a waiting period of 30 days after the date of issue of the check before it can be canceled and replaced by PWI. If the WEBMASTER wants PWI to issue a replacement check before the end of the 30 days period, PWI will charge a cancellation fee of $20 US per cancelled check.

• PWI reserves the right to close ALL accounts operated by a WEBMASTER caught cheating and void all payments. Fraudulent WEBMASTERs will be prosecuted to the fullest extent of the law.

• In the even that the gaypornaccess program is closed by PWI, notification will be sent to the WEBMASTER and all monies due will be paid and settled for all earnings generated up to that point in time. In the event the WEBMASTER was found in violation of the terms and conditions all monies due will be held.

• In the event that a WEBMASTER wishes to close an account with PWI, they must contact PWI and request for the account to be closed. In this case, PWI will pay for all earnings generated up to that point in time, except in cases where it is determined that the WEBMASTER has cheated by violating these terms and conditions.
Epassporte Payments

• Epassporte is an additional form of payment. It can be used in lieu of being paid by check. The webmaster is still bound to the terms and conditions relevant to the gaypornaccess program.

• If a webmaster doesn’t already have an epassporte Virtual Visa account, PWI has to open a Personnal Account in the Epassporte system. The account, called a Virtual Visa Card account, will be created when the first payment is initiated. The account will be created when the first payment is sent from PWI to the new Virtual Visa Card account for the webmaster. The Initial Payment will be deposited in the webmaster’s account and a fee of five dollars American ($5 US) will be taken from the account by Epassporte as a one time fee to open the account. The Virtual Visa Card Account information will be sent to the webmaster by email at the email listed in their PWI account If the Webmaster has already an account, then PWI can deposit the amount into that account instead of opening a new one .

• The webmaster alone has control of his Virtual Visa Account. PWI has no control of the Virtual Visa Card account it created for a webmaster and will not be responsible for any fees associated with the webmaster’s Virtual Visa Card account.

• Once the Virtual Visa Card account is created, the webmaster will be able to purchase a Visa Electron Card and will be able to link the payments sent by PWI to that Visa Electron Card. This Visa Electron Card can then be used to withdraw the available funds directly from an ATM that accepts the Visa Electron Card.

• All Epassporte payments will be initiated within five (5) business days of the end of the payment period.
PayPal Payments

• Paypal is an additional form of payment. It can be used in lieu of being paid by check or Epassporte. The webmaster is still bound to the terms and conditions relevant to the gaypornaccess program.

• If a webmaster doesn’t already have a PayPal account, it is the WEBMASTER’s responsibility to obtain one.

• The webmaster alone has control of his PayPal Account. PWI has no control of the PayPal account created by a webmaster and will not be responsible for any fees associated with the webmaster’s PayPal account.

• No amount greater than 10,000 $US can be transferred to a PayPal account.

CHANGES TO THESE TERMS AND CONDITIONS

• PWI reserves the right to terminate this agreement or transfer an account from one publicity program to another at any time, for any reason, including, but not restricted to, profitability. In such case, the WEBMASTER will be notified and will be paid for all earnings generated up to that point in time, except in cases where it is determined that the WEBMASTER is in violation of these terms and conditions.

• Any changes to the Terms and Conditions will be posted on the WEBMASTER’s statistic page. The WEBMASTER will then have seven (7) days to comply with the new condition before PWI starts enforcing the changes. If the WEBMASTER is found in violation of the new Terms and Conditions after 7 days, his account will be terminated and the payment of incomes generated since the application of the new Terms and Conditions will be voided.
